1. Order Requests and Acceptance

Submitting an order request through this website does not create a confirmed order, contract for sale, or guarantee of availability. An order is accepted only after Cyn confirms availability, product details, price, and pickup arrangements with you.

Yum Tums by Cyn may decline or request changes to an order because of scheduling, capacity, ingredient availability, food safety, legal requirements, inappropriate requested content, or other reasonable business considerations.

2. Ohio Sales and Local Pickup

Yum Tums by Cyn operates in Ohio and cottage food products are offered for sale only within Ohio. Current website ordering is intended for local pickup in or around Bryan, Ohio at a location, date, and time confirmed directly with the customer.

The website may be viewed and an inquiry may technically be submitted from outside Ohio, but website accessibility does not constitute an offer or agreement to sell, ship, or deliver cottage food products outside Ohio. Yum Tums by Cyn does not offer interstate shipping of cottage food products through this website.

3. Products and Custom Designs

Yum Tums by Cyn offers homemade cottage food products such as decorated cookies, Buckeyes, brownies, and other qualifying products. Custom products are handmade. Colors, shapes, decorations, dimensions, and appearance may vary from photographs, inspiration images, or previous orders.

Photographs on this website illustrate examples of prior work or the general type and style of products offered. They do not guarantee that a future order will be identical.

4. Customer-Submitted Inspiration Images

The order form may permit customers to submit photographs or other images as visual references for custom goods. An uploaded image is an inspiration reference and does not guarantee exact reproduction. Yum Tums by Cyn may simplify, adapt, or decline a requested design.

You may submit only images that you own, are authorized to share, or otherwise have a lawful right to provide for this purpose. You must not upload material that is illegal, sexually explicit, exploitative, abusive, hateful, threatening, harassing, defamatory, invasive of another person's privacy, depicts sexual exploitation of minors, promotes illegal activity, or is otherwise inappropriate for a small home bakery to receive or reproduce. Do not upload confidential documents, identification documents, financial information, medical records, passwords, or other unnecessary sensitive information.

By submitting an image, you represent that your submission complies with these requirements and grant Yum Tums by Cyn permission to receive, view, process, and use the image only as reasonably necessary to review, discuss, create, and fulfill the requested order and maintain related business records. Yum Tums by Cyn may reject an order or delete submitted material that violates these Terms or is reasonably considered inappropriate.

Customer-provided images are not automatically licensed to Yum Tums by Cyn for public marketing or portfolio use merely because they were submitted with an order request.

5. Intellectual Property and Requested Designs

Customers are responsible for ensuring they have the right to provide requested names, logos, artwork, photographs, characters, trademarks, or other protected material as inspiration for a custom order. Submission of a request does not require Yum Tums by Cyn to reproduce protected material, and Yum Tums by Cyn may modify or decline a design when appropriate.

Nothing on this website represents that Yum Tums by Cyn is affiliated with, sponsored by, endorsed by, or licensed by any third-party brand, sports organization, entertainment property, trademark owner, or other rights holder unless expressly stated.

6. Ohio Cottage Food Products

Products offered as cottage foods are intended to comply with Ohio requirements governing qualifying non-potentially hazardous foods produced in a home kitchen. Yum Tums by Cyn will not knowingly accept through its cottage food operation an order for a product requiring time or temperature control for safety or another product prohibited from production as an Ohio cottage food.

Qualifying cottage food products are labeled as required by applicable law, including the statement “This Product is Home Produced.”

7. Ingredients and Allergens

Products may contain or come into contact with common food allergens, including milk, eggs, peanuts, tree nuts, wheat, soy, and sesame. Ingredient and allergen information applicable to the purchased product will be provided on its label as required by law. Customers with allergies, intolerances, sensitivities, dietary restrictions, or other ingredient concerns should disclose them before an order is confirmed.

Yum Tums by Cyn does not represent that its home kitchen is allergen-free and cannot guarantee the absence of cross-contact. Customers are responsible for reviewing the product's ingredient and allergen information before consuming or serving it. If you or an intended consumer has a severe or life-threatening food allergy, do not rely on a custom request or website message as a substitute for the product's ingredient and allergen label.

8. Pricing and Payment

Website prices are informational and may change. Final price, quantity, and any custom-design charges will be confirmed before an order is accepted. Unless otherwise agreed directly with the customer, payment is due in cash at pickup.

Do not submit credit card numbers, bank account information, Social Security numbers, or other sensitive financial information through the website.

9. Pickup and Scheduling

Dates and time windows submitted through the website are requests only. Pickup is available only at a date, time, and location confirmed by Cyn. Customers are responsible for arriving within the confirmed pickup arrangement or contacting Cyn promptly if circumstances change.

10. Changes and Cancellations

Because products may be made specifically for an individual customer, requested changes or cancellations should be made as early as possible. Whether a change or cancellation can be accommodated depends on production progress and whether ingredients or custom materials have already been purchased or prepared. Any additional cancellation or change terms specific to an order will be communicated when the order is confirmed.

11. Storage, Handling, and Consumption After Pickup

After pickup, the customer is responsible for appropriate transportation, storage, handling, and serving of the products. Follow any product-specific instructions provided by Yum Tums by Cyn. Products should not be consumed if packaging has been materially damaged, the product appears contaminated or spoiled, or another reasonable food-safety concern exists.

12. Ordinary Food Risks and Legal Rights

Food consumption involves ordinary risks, including allergic reactions, sensitivities, choking hazards, and deterioration caused by improper transportation, handling, or storage after pickup.

Nothing in these Terms is intended to waive or restrict a right or responsibility that cannot lawfully be waived under applicable law, or to exclude liability for fraud, intentional misconduct, or other liability that applicable law does not permit to be excluded.

13. Website Information and Availability

Yum Tums by Cyn attempts to keep product descriptions, photographs, pricing, availability, and other website information reasonably accurate, but offerings may change. A particular design, ingredient, product, date, quantity, or price is not guaranteed until the order is confirmed.

The website may occasionally be unavailable or contain technical or typographical errors. Yum Tums by Cyn may correct website information when errors are discovered.

14. Website Content and Copyright

Unless otherwise indicated, original Yum Tums by Cyn website text, original product photographs, graphics, branding elements, and other original copyrightable content are owned by or used with permission by Yum Tums by Cyn and are provided for personal viewing in connection with the business.

Original site content may not be copied, republished, commercially exploited, falsely represented as another seller's work, or used to imply an affiliation with Yum Tums by Cyn without permission, except where applicable law permits the use.

Third-party names, trademarks, logos, characters, or other protected material, if depicted or referenced, remain the property of their respective owners. Their appearance does not imply sponsorship, affiliation, or endorsement.

15. Privacy

Use of the website and submission of an order request are also subject to the Privacy Policy, which explains the website's collection, use, disclosure, and retention of personal information.

16. Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles, except to the extent another law necessarily applies and cannot lawfully be excluded. Nothing in this provision eliminates consumer rights that applicable law does not permit the parties to waive.

17. Severability

If a provision of these Terms is found unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.

18. Changes to These Terms

These Terms may be updated when the business, website, products, practices, or applicable legal requirements change. The “Last updated” date at the top identifies the current version. Changes apply prospectively unless applicable law requires otherwise.
